Terms and Conditions of Use for WEDISPATCH Desktop Application

These General Terms of Use are updated and effective as of May 1, 2024.

This document ("General Terms of Use" or "Agreement") defines the terms under which the use of the WEDISPATCH desktop application ("Application") is regulated. Along with the WEDISPATCH Privacy Policy, these Terms constitute a legal contract between ("you" or "user") and WEDISPATCH SOFTWARE.

Operated and managed by FCargo Group LLC (registered under the laws of the State of Texas, headquartered at [2001 Timberloch PL STE 500 SPRING TX 77380-1375, USA]) ("WeDispatch," "we," or "our"). FCargo Group LLC may add, modify, or delete features at any time, which the user accepts by installing the application. In any case, when making such modifications, the user will be notified through the same mobile application once logged in.

Authorized Access and Use of the Application

The ("applicant," "user") must be a professional freight dispatcher working for or owning a dispatch company providing services for the USA.

To access the benefits, features, and content of the WEDISPATCH desktop application, the user must first meet all registration requirements requested by the application.

The User undertakes to use the WEDISPATCH desktop application and its functions and the contents found therein diligently, correctly, lawfully, and especially, undertakes NOT to perform conduct outside the norms of the law, being the responsibility of the user of the WEDISPATCH desktop application to make correct use of the application.

Functions and Services

The application aims to connect Transporters with available Freight Dispatchers, centralizing the information and workflow of both parties in WEDISPATCH SOFTWARE. This application is integrated with systems that obtain location and functions such as chat, profitability analysis, payment system, reports, among others.

Purchase and Sale

The WEDISPATCH desktop application offers technological services with an established workflow in the software to connect Transporters and available Dispatchers, with the aim of generating trade between these two.

Payment for Services

Payment for the service will be made according to the rates established by the software provider and will be processed through the application using secure payment methods.

Cancellation Policy

Users of the WEDISPATCH application may cancel a load before the driver ETA, however, if the user wishes to cancel a load after receiving PU ETA, they must justify the reasons for canceling it to the driver of that load.

Provider's Liability

Service providers (WEDISPATCH desktop application users) are responsible for providing the service in accordance with industry standards and quality. In case of problems or dissatisfaction with the service, users can contact application support to resolve the situation.

Refunds, Guarantees, and Dispute Resolution

Refunds will be subject to the service provider's refund policy and the provisions of the application's refund policy. In case of disputes between users and service providers, FCargo Group LLC opens its administrative doors to facilitate communication and mediation to resolve the problem amicably.
